SMS TERMS & CONDITIONS

These SMS Terms & Conditions ("SMS Terms") govern your use of the text messaging program operated by Top Dog Properties and Investments LLC d/b/a Investor's Realty Group ("we," "us," or "our"). By opting in to receive SMS messages from us, you agree to these SMS Terms. Please read them carefully.
PROGRAM DESCRIPTION
Top Dog Properties and Investments LLC d/b/a Investor's Realty Group operates an SMS messaging program for clients, prospects, and interested parties. The program consists of two distinct message categories:
1. Transactional Messages — appointment confirmations, reminders, follow-up communications related to your inquiry, and other service-related messages.
2. Marketing & Promotional Messages — recurring automated marketing and promotional messages including property alerts, off-market investment opportunities, market updates, and related real estate content.
Each category requires its own separate, optional consent. You may consent to one, both, or neither.
HOW TO OPT IN
You may opt in to our SMS program by visiting https://www.investorsrealty.group/text-alerts and completing the opt-in form. The form collects your first name, last name, email address, and mobile phone number. Beneath the form are two separate, unchecked-by-default consent checkboxes — one for transactional messages and one for marketing messages. To join the SMS program, you must actively check the applicable checkbox(es) before submitting the form.
Providing your phone number alone does not constitute consent to receive SMS messages. SMS consent is given only when you actively check a consent checkbox.
Both SMS consents are entirely optional. Neither is required to submit the opt-in form, contact us, or receive our real estate services. You may submit the form without checking either checkbox and still use our website and services normally.
MESSAGE FREQUENCY
Message frequency varies. If you consent to marketing messages, you may receive up to 8 marketing messages per month. Transactional message frequency depends on your interactions with us and the nature of your inquiry.
MESSAGE & DATA RATES
Message and data rates may apply depending on your mobile carrier and plan. Please check with your wireless provider for details about your messaging plan. Top Dog Properties and Investments LLC d/b/a Investor's Realty Group is not responsible for any charges incurred from your wireless carrier.
HOW TO OPT OUT
You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After you reply STOP, we will send you one final confirmation message acknowledging your opt-out request, and no further SMS messages will be sent to your number.
If you wish to re-subscribe after opting out, reply START to the same number, or visit https://www.investorsrealty.group/text-alerts and submit the opt-in form again.
Opting out of SMS messages does not affect any other communications you may receive from us (such as email or phone calls), and does not affect your ability to use our website or services.

PRIVACY AND DATA SHARING
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of personal information exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
SMS data is shared only with SMS service providers and wireless carriers strictly for the purpose of delivering messages to you. These providers are contractually prohibited from using SMS opt-in data for any other purpose. We do not sell, rent, lease, or otherwise disclose SMS opt-in data or consent information under any circumstances.

SUPPORTED CARRIERS
SMS messaging is available on major U.S. wireless carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, and others. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's network availability and is not guaranteed.
ELIGIBILITY
To participate in our SMS program, you must be at least 18 years old and a resident of the United States. By opting in, you represent and warrant that you meet these eligibility requirements and that the mobile phone number you provided is your own or that you have authorization to opt in that number to receive messages from us.
CHANGES TO THESE SMS TERMS
We reserve the right to modify or update these SMS Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date. Continued participation in the SMS program after such changes are posted constitutes your acceptance of the updated SMS Terms. If we make material changes, we may notify you directly via SMS or email.
DISCLAIMER OF WARRANTIES
The SMS program is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, error-free, or timely delivery of any SMS message. We are not responsible for any technical issues, network failures, or carrier-related delays that may prevent or delay message delivery.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Top Dog Properties and Investments LLC d/b/a Investor's Realty Group shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your participation in the SMS program, including but not limited to message delivery failures, carrier charges, or any reliance on the content of any SMS message.
GOVERNING LAW
These SMS Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any disputes arising out of or related to these SMS Terms shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina.
